Terms of Service
Last updated: 9 October 2026
These terms apply to the dubicon.net website and to the services Dubicon provides: store reviews, account audits, email flow builds, monthly campaigns and related add-ons. Dubicon is run by Yağız D. Suluoğlu in Istanbul, Türkiye. By using the site or our services, you agree to these terms. If a written proposal or agreement we’ve both accepted says something different, the proposal or agreement takes priority.
1. Store reviews
Store reviews are free and come with no obligation. They’re based on what’s publicly visible on your store and the emails we receive after signing up. They’re general observations to help you decide what to do next, not a guarantee of results.
2. Proposals and scope
Every project starts with a written proposal that sets out the scope, deliverables, timeline and price. Work starts once you accept the proposal and any first payment it asks for has arrived. If you ask for work outside the agreed scope, we’ll quote it separately and won’t start it without your approval.
3. Fees and payment
Prices are in US dollars unless the proposal says otherwise. The payment schedule is set out in your proposal. Unless it says something different:
- projects are paid 50% before work starts and 50% on delivery;
- monthly services are billed in advance at the start of each month.
If a payment is late, we may pause the work until it arrives. Prices don’t include taxes that may apply in your country. Third-party costs, such as your Klaviyo plan, apps, fonts or stock images, are paid by you directly to those companies.
4. Your responsibilities
- Give us accurate information, the access we need, your brand assets and timely feedback. Delays on your side may move the timeline.
- Make sure you have permission to email your subscribers, and that your email marketing follows the laws that apply to your business, such as CAN-SPAM, GDPR or CASL.
- Review and approve content before it’s sent. Product claims, offers, prices and legal statements in your emails are yours to confirm.
5. Drafts and approvals
We share drafts for your review before anything is built or sent. The number of revision rounds included is set out in your proposal. Nothing goes live without your approval.
6. Results
We work carefully and share what we know works, but we can’t guarantee specific revenue, open rates, deliverability or other outcomes. They depend on many things outside our control, including your products, prices, list and the email platforms themselves.
7. Third-party platforms
Klaviyo, Shopify and other tools we work with are run by other companies under their own terms. We’re not responsible for their outages, changes to their features or pricing, or decisions they make about your account.
8. Ownership
Once you’ve paid in full, you own the final emails, copy and designs we create for you. We keep ownership of our own tools, templates, methods and know-how, and you get a permanent licence to use any of them that are built into your deliverables. We’ll only name you as a client or show your work in our portfolio with your permission.
9. Confidentiality and contractors
We each keep the other’s non-public information confidential, during and after the work. We access your accounts only to do the agreed work. We may involve trusted contractors for parts of a project; they work under our direction and confidentiality obligations, and we remain responsible for everything we deliver.
10. Ending the work
Either of us can end a project or a monthly service by telling the other in writing. For projects, you pay for the work completed up to that point; for monthly services, cancellation takes effect at the end of the month you’ve paid for. Our Refund Policy explains the details. We may end the work if payments are significantly late or these terms are seriously broken.
11. Limits of liability
To the extent the law allows, we aren’t liable for indirect or consequential losses, such as lost profits, lost revenue or lost data. Our total liability for any claim relating to our work is limited to the fees you paid us for that project or, for monthly services, the fees you paid in the three months before the claim. Nothing in these terms limits liability that can’t be limited by law.
12. Using this website
The content on dubicon.net is for general information and may change. Please don’t misuse the site, for example by trying to disrupt it or access it without permission. Links to other websites are provided for convenience; we aren’t responsible for their content.
13. Governing law
These terms are governed by the laws of the Republic of Türkiye, and the courts of Istanbul have jurisdiction over any dispute, unless mandatory law where you are says otherwise. Before going to court, we’ll both try to resolve any disagreement directly and in good faith.
14. Changes and contact
We may update these terms from time to time. The version on this page applies from the date shown at the top; work already agreed in a proposal continues under the terms in place when the proposal was accepted. Questions: yagiz@dubicon.net.
